Judge Decides Trial In Death Of Deputy

A court hearing is scheduled for today to determine if a Macomb County man is now competent to stand trial in the death of an Oakland County sheriff’s deputy.

22 year old Christopher Berak was charged in the death last November of 50 year old deputy Eric Overall.

Berak had gone to the Lapeer County jail saying that he was a worker of God and intended to break out one of his sons who was being held.

He then fled the scene heading into Oakland County and deputies there were notified.

Overall had thrown some stop sticks across the M-15 freeway in an attempt to flatten Berak’s tires.

Investigators say Berak then swerved his car and ran over the deputy.

Berak was taken into custody at the scene.

At a subsequent court hearing, on a request from his attorney, he was then sent to the Forensic Center in Ypsilanti for a competency exam.

He’s due back in court today for an update on his testing.
