GOP Gets Hearing On County Exec

A lawsuit seeking to remove an Oakland County commissioner from the board and canceling his actions to appoint a new county executive will get a hearing in court.

Oakland County Republicans filed the lawsuit to remove Commissioner Dave Woodward from the board, which would overturn the appointment of County Executive David Coulter.
The lawsuit charges Woodward unlawfully took part in a commission meeting to replace the successor to the late L-Brooks Patterson because Woodward had resigned his seat on the board, and later rescinded the resignation. Woodward had hoped to be appointed.
Woodward then voted to name Coulter to the post.
The Republicans lost an attempt to block Woodward from returning to the Board of Commissioners.
The attorney for the Democrats, Floyd Allen, cites an attorney-general’s opinion that says a resignation by a public official is final only after a governing body votes to accept it. The board had not voted to accept the resignation.
The hearing is before Judge Daniel O’Brien.
