April 11, 2024 ~ The Biden admin finally weighed in on the future of Line 5, arguing that its shutdown would harm U.S.-Canadian relations but its owner should also recognize Native Americans‘ sovereign rights to their lands.
The federal report commented on an ongoing legal battle out of Wisconsin between Enbridge, the owner of the oil pipeline, and the Bad River Band of Lake Superior Chippewa, with a district court judge ruling in 2023 that the portion on Native American land should be removed by 2026. The pipeline has faced criticisms for decades, with Michigan Attorney General Dana Nessel embroiled in her own legal battle against the pipeline over its placement in the Straights of Mackinac.
