Michigan Supreme Court considering revision of “pay or stay” sentences

The Michigan State Supreme Court is considering a rule that will offer options for people facing jail time if they are unable to pay court fees. The proposal is designed to stop so-called “pay or stay” sentences, in which a District Court judge orders jail time because the offender is unable to pay imposed fines. The U.S. Supreme Court banned the practice in the 1980’s, but some Michigan judges continue to issue jail sentences despite prelation within the judicial system. If adopted, the stiffer regulations will allow judges to waive fees or issue payment plans for low-income litigants.
